BEFORE: KEITH, MERRITT and KENNEDY, Circuit Judges Order This case is before the Court on a motion by plaintiff-appellant Potemra to be allowed to proceed in forma pauperis on appeal. The defendants-appellees have filed a motion opposing Potemra's motion and requesting this Court to order Potemra to stop filing motions concerning this case. The case has been referred to a panel of the Court pursuant to Rule 9(a), Rules of the Sixth Circuit. Upon an examination of the record, this panel agrees unanimously that oral argument is not needed. Rule 34(a), Federal Rules of Appellate Procedure. Potemra is appealing from the district court's denial of potemra's third motion to reopen his case under Rule 60(b), Federal Rules of Civil Procedure. The granting or denying of such a motion is within the sound discretion of the district court. H.K. Porter Co. v. Goodyear Tire and Rubber Co., 536 F.2d 1115, 1119 (6th Cir. 1976). On these facts, the district court did not abuse its discretion when it denied the motion.
